Terms of Service

This Vehicle Rental Agreement ("Agreement") is entered into between KZ Travel and Tours Sdn Bhd ("KZ", "we", "our", "us") and You, the person who rents the Rental Vehicle ("Renter", "you", "your") during the Rental Period.

1. OWNERSHIP OF THE RENTAL VEHICLE

1.1 The Renter acknowledges that the Rental Vehicle shall at all times remain the property of KZ Travel and Tours Sdn Bhd, and the Renter shall acquire no rights to the Rental Vehicle other than the right to use it in accordance with this Agreement.
1.2 The Renter shall not sell, assign, transfer, sublet, lend, or part with possession of the Rental Vehicle to any third party.
1.3 Any unauthorized use or possession of the Rental Vehicle shall constitute a breach of this Agreement and may result in immediate termination and repossession.

2. DISCLAIMER

2.1 Save as otherwise expressly provided in this Agreement, KZ makes no other warranties to the Renter in relation to the Rental Vehicle. To the maximum extent permitted by law, KZ disclaims all express, implied or statutory conditions, representations and warranties, including but not limited to any implied warranty or condition of merchantability and fitness for a particular purpose.
2.2 KZ shall not be liable for any indirect or consequential loss or damage (including, without limitation, any loss of actual or anticipated profits, loss of revenue, loss of business, loss of opportunity, loss of goodwill and loss of reputation) or punitive damages, regardless of the basis of the claim, whether in contract, tort, strict liability or other legal or equitable theory.

3. RENTAL & OTHER CHARGES

3.1 The rental charges for the Rental Vehicle shall be as stipulated on the KZ Car Rental website and/or booking platform.
3.2 Payment for the rental charges shall be made in advance via the options made available by KZ, including but not limited to ToyyibPay (FPX / Online Banking / CommercePay Card Payments), Bank Transfer, and such other payment methods as may be made available.
3.3 The Renter will not be able to access and drive the Rental Vehicle unless the rental charges have been paid in full.
3.4 In the event of any default in payment, KZ shall be entitled to impose a late payment interest at the rate of eight percent (8%) per annum on the outstanding charges ("Late Payment Interest").
3.5 All payments made through ToyyibPay are subject to the terms and conditions of ToyyibPay. KZ shall not be liable for any disputes arising from the payment gateway provider.

4. TAXATION

4.1 In the event the Sales and/or Services Taxes ("SST") or any other applicable taxes are imposed by the relevant Malaysian authorities on the rental charges, the Renter agrees to bear such taxes.
4.2 All prices displayed on the KZ Car Rental website are inclusive of SST unless otherwise stated.

5. RENTAL PERIOD DELIVERY ETA

5.1 The Renter shall select the rental period by choosing the start date/time and end date/time at the time of booking.
5.2 12-Hour Package: Fixed from 8:00 AM to 8:00 PM on the same day (Malaysia Time GMT+8).
5.3 24-Hour Package: Flexible start time between 8:00 AM and 8:00 PM, with return time 24 hours later or as agreed.
5.4 The minimum rental period is 12 hours. The maximum rental period is 30 days.
5.5 Extensions are subject to availability and must be requested before the end of the Rental Period.
5.6 Delivery ETA: Booking confirmation will be sent within 5 minutes of successful payment.

6. USE OF THE RENTAL VEHICLE

6.1 Pickup and Return

6.2 Late Return

6.2.1 The Rental Vehicle must be returned during operating hours (8:00 AM – 8:00 PM) on or before the expiry of the Rental Period.
6.2.2 If the Renter fails to return the Rental Vehicle by the expiry of the Rental Period, the Renter shall be charged a late return fee as follows:
Late Return Duration Charge
1 – 12 hours Full 12-hour package rate
13 – 24 hours Full 24-hour daily rate
More than 24 hours Daily rate for each additional day or part thereof
6.2.3 For 12-hour bookings (8:00 AM – 8:00 PM):
  • The vehicle must be returned by 8:00 PM on the same day.
  • If the Renter fails to return by 8:00 PM, the vehicle cannot be returned until 8:00 AM the next day when the counter reopens.
  • Returned between 8:00 PM – 8:00 AM (next day): The vehicle is effectively 12 hours late → Charged the full 12-hour package rate.
  • Returned after 8:00 AM (next day): The vehicle is more than 12 hours late → Charged the full 24-hour daily rate.
6.2.4 For 24-hour bookings (flexible pickup time):
  • The vehicle must be returned by the agreed return time (within operating hours).
  • If returned up to 12 hours late: Charged the full 12-hour package rate.
  • If returned between 13 and 24 hours late: Charged the full 24-hour daily rate.
6.2.5 Important Operating Hours Restriction:
  • No returns are accepted after 8:00 PM.
  • If the Renter is unable to return the vehicle by 8:00 PM, the Renter must keep the vehicle until 8:00 AM the next day.
  • Late return fees will apply for the entire delay period until the vehicle is returned.
6.2.6 The late return fee shall be in addition to any other charges payable under this Agreement.
6.2.7 KZ reserves the right to repossess the Rental Vehicle in accordance with Clause 8 if the Renter fails to return the vehicle within a reasonable time after the expiry of the Rental Period.
6.2.8 Examples:
  • If the car's 12-hour rate is RM 100 and the daily rate is RM 130:
    • 6 hours late → Full 12-hour rate = RM 100
    • 12 hours late → Full 12-hour rate = RM 100
    • 15 hours late → Full daily rate = RM 130
    • 30 hours late → 2 × RM 130 = RM 260 (2 days)
  • 12-hour booking (8:00 AM pickup, due 8:00 PM):
    • Returned 9:00 PM → Must wait until 8:00 AM → 12 hours late → Charge RM 100
    • Returned 9:00 AM next day → 13 hours late → Charge RM 130
  • 24-hour booking (8:00 AM pickup, due 8:00 AM next day):
    • Returned 9:00 AM → 1 hour late → Charge RM 100 (12-hour rate)
    • Returned 2:00 PM → 6 hours late → Charge RM 100 (12-hour rate)
    • Returned 7:00 PM → 11 hours late → Charge RM 100 (12-hour rate)
    • Returned 9:00 PM → Must wait until 8:00 AM → 13 hours late → Charge RM 130 (daily rate)
    • Returned 9:00 AM next day → 25 hours late → Charge RM 260 (2 × daily rate)

7. PARKING & FINES

7.1 The Renter shall be solely liable for all parking fees, traffic fines, penalties, replacement access cards or summonses incurred during the Rental Period.
7.2 Any parking fees, traffic fines, penalties or summonses incurred, together with an additional administration fee of RM10.00 (subject to SST), will be charged to the Renter.
7.3 The Renter shall be responsible for any toll charges incurred (Touch 'n Go or RFID) during the Rental Period.
7.4 Traffic summons linked to the vehicle's registration plate during the Rental Period will be traced to the Renter. KZ is required by law to provide the Renter's details to the Road Transport Department (JPJ) when a summons is issued.

8. REPOSSESSION OF THE RENTAL VEHICLE

8.1 KZ shall be entitled to repossess the Rental Vehicle without sending any notice to the Renter where there has been a breach of the terms of this Agreement or the Renter has failed to return the Rental Vehicle upon expiry.
8.2 To the fullest extent permitted by law, the Renter waives any right to any hearing or to receive any notice or legal process as a pre-condition for repossession.
8.3 The Renter authorises KZ to enter any premises owned or occupied by the Renter for purposes of repossessing the Rental Vehicle.
8.4 The Renter shall reimburse KZ for all costs and expenses incurred in the repossession of the Rental Vehicle.

9. SERVICE & MAINTENANCE

9.1 If the Renter experiences any problem with the Rental Vehicle, the Renter may seek assistance by contacting KZ via WhatsApp: +60 19-983 3103 or Email: admin@kzcarrental.com.my.
9.2 The Renter shall not allow any third party to carry out any repair, service, or maintenance work without KZ's prior written consent.
9.3 The Renter shall be responsible for any additional costs incurred from tow truck assistance rendered.

10. REPLACEMENT VEHICLE

10.1 KZ shall not be obliged to provide any replacement vehicle to the Renter. Replacement is subject to availability and assessed on a case-by-case basis.

11. INSURANCE

The rental charges include basic third-party liability insurance coverage:

12. TERMINATION OF THE AGREEMENT

12.1 This Agreement shall automatically terminate upon the expiry of the Rental Period unless there is a prompt extension by the Renter.
12.2 KZ may terminate this Agreement immediately with written notice if there is a breach of any terms of this Agreement by the Renter.

13. CONSEQUENCES OF EXPIRY/TERMINATION

13.1 Upon the expiry or termination of this Agreement, the Renter shall forthwith return the Rental Vehicle to the designated location, failing which the late return penalty fee shall apply and KZ shall be entitled to repossess the Rental Vehicle.
13.2 The Rental Vehicle shall be returned in good order, repair, and condition (fair wear and tear excepted). KZ shall be entitled to charge such reasonable amount as may be necessary to restore the Rental Vehicle to pre-rental condition.
13.3 The Rental Vehicle shall be returned with the same fuel level as specified at pickup. If not, a refuelling service charge, subject to SST, will be charged to the Renter.

14. FORCE MAJEURE

14.1 KZ shall not be liable to the Renter for the failure or delay to perform any of its obligations under this Agreement due to any cause arising out of war, rebellion, civil commotion, strikes, lock-outs, industrial disputes, fire, explosion, Act of God, flood, landslide, earthquake, or government order, or any other event which could not have been foreseen and/or prevented with reasonable precautions ("Force Majeure Event").
14.2 If KZ is unable to perform its obligations due to a Force Majeure Event, KZ shall within seven (7) days give written notice to the Renter.
14.3 The operation of this Agreement shall be suspended during the period in which the Force Majeure Event continues. If the Force Majeure Event prevents KZ from performing its obligations for a continuous period of more than thirty (30) days, KZ may terminate this Agreement by giving written notice.

15. MISCELLANEOUS GOVERNING LAW DISPUTE RESOLUTION

15.1 Time of the Essence — Time wherever mentioned in this Agreement shall be of the essence.
15.2 Severability — If any provision is invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
15.3 Waiver — Failure by KZ to enforce any provision shall not constitute a waiver of any rights.
15.4 Governing Law — This Agreement shall be governed by and construed in accordance with the laws of Malaysia. The parties hereby agree to submit to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia in connection with any dispute arising out of or in connection with this Agreement.
15.5 Dispute Resolution
  1. Informal Resolution: The parties shall first attempt to resolve the dispute through good-faith negotiations within 14 days of the dispute arising.
  2. Mediation: If informal resolution fails, the parties shall attempt to resolve the dispute through mediation with a mutually agreed mediator.
  3. Arbitration: If mediation fails, the dispute shall be finally settled by arbitration in accordance with the rules of the Kuala Lumpur Regional Centre for Arbitration (KLRCA).
  4. Jurisdiction: The courts of Kuala Lumpur, Malaysia shall have exclusive jurisdiction over any disputes not resolved through the above methods.
